These Terms and Conditions (“Terms”) govern the sale of products by By Kidda AB (“Supplier”) to the Purchaser through our online sales platform available at www.bykidda.com (the “Website”). By placing an order with us, the Purchaser agrees to be bound by these Terms.

1) Definitions

• "Online Sales Contract" refers to the contract entered into by By Kidda AB and the Purchaser through our sales platform managed by By Kidda AB.
• "Purchaser" refers to a consumer – either a natural person or legal entity purchasing goods from By Kidda AB for purposes unrelated to commercial or professional activities.
• "Supplier" refers to By Kidda AB, the entity selling goods as described on the Website.

2) Object of the Contract

2.1 The contract involves the sale of physical products by By Kidda AB to the Purchaser through the Website.

2.2 The products offered for sale are described in detail on the Website. By placing an order, the Purchaser acknowledges reading and accepting these Terms.

2.3 The Purchaser is not entitled to reimbursement for damages due to any failure to approve an order.

2.4 Orders are only available for physical products.

2.5 The Purchaser may buy goods displayed and described on the Website by completing the order process.

3) Procedure for the Execution of the Contract

3.1 The contract between By Kidda AB and the Purchaser is executed remotely over the internet. After placing an order, By Kidda AB may perform verification checks (e.g., address verification, fraud control).

3.2 By Kidda AB reserves the right to refuse or cancel any order, including after sending the order confirmation, in the following cases:

• Product unavailability
• Incorrect or unverifiable invoicing/shipping data
• Suspicious or fraudulent activity
• Purchaser is under the age of majority in your state or province of residence,or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependets to use this site.
• Incorrect product pricing
• Delivery issues (e.g., incorrect address)

4) Conclusion and Efficacy of the Contract

4.1 The sales contract is concluded once the Purchaser has completed the order process and submitted the order.

4.2 A confirmation email will be sent to the Purchaser, listing the order details and confirming the contract.

4.3 If the terms are not followed, the contract will be void.

5) Methods of Payment and Reimbursement

5.1 We accept payments via credit card, debit card, bank transfer, and PayPal.

5.2 Refunds will be processed within 30 days if the Purchaser is entitled to a refund under the withdrawal policy.

6) Delivery of Goods

6.1 By Kidda AB will deliver products to the shipping address provided by the Purchaser.

6.2 Products will be delivered via courier service.

6.3 Orders containing in-stock and out-of-stock items will be delivered in a single shipment once all items are available.

6.4 The Supplier is not liable for delays caused by unforeseen events or force majeure.

6.5 The Purchaser must inspect the package upon delivery and inform By Kidda AB of any damages within 2 days.

6.6 For international shipments, the Purchaser is responsible for customs duties and other fees. By Kidda AB will cover return shipping costs in cases of unsuccessful delivery.

7) Prices

7.1 Prices are displayed in the Purchaser’s native currency or in Euros (if no native currency is set).

7.2 Prices include VAT and applicable taxes. Shipping costs will be communicated at the time of order confirmation.

7.3 Prices are valid until updated on the Website.

8) Availability of Products

8.1 By Kidda AB strives to process and ship orders promptly.

8.2 If a product is unavailable, By Kidda AB will notify the Purchaser and offer the option to confirm or cancel the order.

9) Limited Liabilities

9.1 By Kidda AB is not liable for delays or damages resulting from force majeure events or factors beyond control.

9.2 By Kidda AB is not liable for damages or losses not attributable to its actions.

9.3 Due to the handmade nature of our perfumes, slight variations in the liquid quantity may occur between bottles.While we take great care to ensure consistency ,these differences to not affect the quality,concentraion or fragrance of the product and are not considered defects.

9.4 Since the perfumes are handcrafted in small batches, slight variations in scent profile may occur between productions. These subtle diferences are a natural result of our artisanal process and do not affect the overall quality or essence of the fragrance.

10) Purchaser’s Obligations

10.1 The Purchaser agrees to pay for the goods ordered within the specified timeframes.

10.2 The Purchaser must keep a copy of the contract for their own records.

11) Right to Withdraw and Return of Goods

11.1 The Purchaser is entitled to withdraw from the contract within 14 days of receiving the order. Exceptions to this right include custom or perishable items.

11.2 To withdraw, the Purchaser must notify By Kidda AB within the specified period.

11.3 Products must be returned in original packaging and in a resalable condition.

11.4 If the product is returned damaged or incomplete, the Purchaser may not be entitled to a full refund.

11.5 By Kidda AB covers return shipping costs in cases of unsuccessful delivery.

11.6 A refund or replacement will be issued in accordance with the returns policy.

12) Warranty

12.1 Products are covered by the legal warranty for conformity defects, according to applicable Swedish consumer protection laws.

12.2 Warranty claims must be made within 24 days of receiving the product. The Purchaser must provide the original invoice and photographic evidence of the defect.

12.3 For products with a defect, By Kidda AB will either repair, replace, or refund the product.

13) Grounds for Termination

13.1 The contract may be terminated if the Purchaser fails to meet obligations, such as timely payment or providing accurate order details.

14) Methods of Filing the Contract

14.1 By Kidda AB will store all orders digitally, ensuring confidentiality and security.

15) Applicable Law and Dispute Resolution

15.1 These Terms are governed by Swedish law. Any disputes will be handled by the Swedish courts.

15.2 In case of disputes, the Purchaser may contact Swedish authorities or initiate proceedings in the Tribunal of Malmö, Sweden.

16) Order Cancellations

16.1 The Purchaser may cancel the order within 4 hours of placing it, provided the order status is not marked as "Payment Accepted."

16.2 After the 4-hour cancellation window, the order cannot be canceled.

17) Shipping to Countries

17.1 By Kidda AB ships products globally. However, we cannot ship to countries where Sweden has active trade sanctions or where cooperation with a specific country is not permitted.

17.2 International orders are subject to customs duties, taxes, and additional fees. The Purchaser is responsible for these charges.
